PER NAVEEN CHANDRA [A. M]:

CIT(A)), under section 250 of the Income Tax Act, 1961 [hereinafter referred to as, “Act”] for Assessment Year 2018-19. The assessment order in this appeal dated 11.03.2023 is passed by the Assessing Officer [for short, AO] under section 144 r.w.s. 147 of the Act.

2.

None was present on behalf of the assessee, therefore we have decided to hear the case ex-parte with the assistance of ld. DR.

3.

At the outset, the ld. DR pointed out that the Department has filed a petition for withdrawal of the aforesaid appeal on the ground that while uploading Form No.36, the name of the assessee was wrongly entered as Vinay Kumar Thakral instead of Vijay Kumar Thakral. The mistake has been corrected by the Department by filing another appeal under correct name vide appeal no.2386/Del/2026.

4.

In view of the above facts, we allow the Revenue to withdraw its appeal. The appeal of the Revenue is dismissed as withdrawn.

5.

In the result, the appeal of the Revenue is dismissed.
