Judgment
Suo-moto cognizance has been taken in this matter in the light of death of 500 children in BRD Medical College, Gorakhpur on account of failure of statutory regulators to control pollution vide order passed while disposing of Appeal No. 04/2022 filed against order of State PCB declining to waive compensation against BRD Medical College, Gorakhpur for non-compliance of BMW Rules, directed to be levied by this Tribunal. The Tribunal held that the PCB could not waive compensation levied by this Tribunal and thus there was no merit in the appeal. At the same time, compensation for death of children was required to be considered.
We have been dealing with the issue of uncontrolled water pollution in and around Gorakhpur, U.P in O.A No. 116/2014, Meera Shukla v. Municipal Corporation, Gorakhpur & Ors. wherein allegation of number of deaths due to pollution has been made. The Tribunal has passed orders from time to time to take remedial measures and further order is being passed separately order today. Since the entirely of the matter is subject matter of consideration in O.A No. 116/2014, no separate order is necessary in this application.
O.A No. 117/2022 is disposed of accordingly.
