Jwala Prasad, J.—The reference is accepted and, as recommended by the learned Sessions Judge, the conviction and sentences passed on the accused are set aside inasmuch as Act XI of 1890, under which the accused have been convicted, does not apply to the Local Area where the offense is said to have been committed.
