Judgment
This OA is registered in suo motu exercise of power on the basis of the news item titled “Faridabad residents see red over inefficient waste disposal” published in ‘The Tribune’ dated 03.10.2023. The news item mentions about the dumping of solid waste and garbage at various spots, including roadsides, green belts and along the bypass road that is being converted into an expressway.
On advance notice, the report on behalf of the Haryana State Pollution Control Board (HSPCB) has been filed stating that due to breakdown of vehicles and insufficient deployment on the part of M/s. Ecogreen, the BPTP transfer station became filled with garbage, resulting in a temporary accumulation of waste outside the transfer station. Along with the report, a communication dated 30.10.2023 sent by the Nodal Officer, SBM for Commissioner, Municipal Corporation, Faridabad to Deputy Commissioner, Faridabad has been enclosed which states about the following action taken in this regard:
“However, due to the breakdown of vehicles and insufficient deployment on the part of M/s Ecogreen, the BPTP transfer station became filled with garbage, resulting in a temporary accumulation of waste outside the transfer station. In response to this issue, Municipal Corporation Faridabad (MCF) took swift and proactive measures to address the problem and prevent further inconvenience to the public. The actions taken by MCF include:
Additional Resource Deployment & Garbage Lifted: To ensure the timely transfer of piled waste from the area, MCF deployed additional resources and vehicles. Specifically, four Hyva vehicles and two JCBs owned by MCP were mobilized to handle the accumulated waste.
Restoration: Currently, there is no waste dumped on the road portion in front of the transfer station. All the garbage accumulated under the bridge has been lifted and transported to Bandhwari site. The remaining garbage within and near the transfer station shall be systematically cleared and transported on a daily basis.
Municipal Corporation Faridabad acknowledges the seriousness of the issue and is taking all necessary measures to ensure efficient waste management. Municipal Corporation Faridabad has been actively working to mitigate the situation and maintain cleanliness and hygiene in the affected area. The MCF remains committed to providing a clean and hygienic environment for the residents of Faridabad. We will continue to monitor the situation closely, address any underlying concerns, and take necessary actions to prevent similar incidents as and when required.”
Having regard to the fact that after publication of news item and receipt of the notice from the Tribunal by the concerned authorities, remedial action has been taken, we deem it proper to direct the HSPCB to take appropriate action in accordance with law for the past violations and also to ensure that no garbage and solid waste is collected/stored on the spot in question by violating the environmental norms.
The fresh report will be filed in this regard specifically indicating the status of collection, storage, transportation and processing of waste within three months by the HSPCB before the Registrar General of this Tribunal by e-mail at [email protected] preferably in the form of searchable PDF/OCR Support PDF and not in the form of Image PDF. If found necessary, the matter will be listed for consideration.
The OA is disposed of accordingly.
