Judgment

Rule returnable forthwith. The learned APP waives service of notice of rule for and on behalf of the respondent-State.
The applicant made application for temporary bail before the concerned Sessions Court, Morbi and learned Sessions Judge partly allowed the application for temporary bail for a period of three days under police escort and the applicant has to bear the expenses of police escort. The applicant is a very poor and unable to bear such huge amount. Hence present application is filed before this Court on the ground of real sister’s marriage scheduled on 10.06.2023. In support of the application, invitation card is produced on record.
The applicant is arrested in connection with the FIR registered with Vankaner City Police Station, District Morbi for the offence punishable u/s. 302, 120(B), 34 of the IPC and u/s 135 of the G.P.Act.
In the facts and circumstances of the case and taking into consideration the grounds urged in this application, the applicant is ordered to be released on temporary bail for a period of one week from 08.06.2023 on the applicant executing a bond of Rs.15,000=00 (Rupees Fifteen Thousand) to the satisfaction of the concerned authority, on usual terms and conditions.
The applicant shall mark presence before the nearest police station on 09.03.2023 and 13.06.2023.
The applicant shall surrender before the jail authority on or before the expiry of the temporary bail period, without fail.
Rule is made absolute to the aforesaid extent. Direct service is permitted.
The registry shall inform about this order to the Jail Superintendent forthwith.
