This is first bail application filed by the applicant under Section 438 of the Code of Criminal Procedure, 1973. The applicant is apprehending his arrest in connection with Crime No.146/2021, registered at Police Station Jawad, District Neemuch for the offences punishable under Sections 8/15, 29 of the N.D.P.S.Act.
As per prosecution story, on 07.04.2021 on the basis of discrete information, the police apprehended a truck bearing registration number GJ-23- AT-5471 and found 9 quintals 86 kg of poppy straw kept in 45 bags. The driver of the truck and the cleaner were arrested and they disclosed the name of the present applicant to whom they were instructed to deliver the contraband.
Looking to the quantity of the contraband involved in this case which is more than the commercial quantity and the interrogation of the present applicant in this matter, no case for grant of anticipatory bail to the applicant is made out.
Accordingly, this M.Cr.C. is dismissed.
