This is a repeat (second) application filed by the applicant under Section 439 of the Code of Criminal Procedure, 1973 for grant of bail in connection with Crime No.33 of 2022 registered at Police Station – Narcotics Cell, Indore, Prakosht Neemuch, District Neemuch (M.P.) for offence punishable under Section 8 read with Sections 15, 25 and 29 of the Narcotic Drugs & Psychotropic Substances Act, 1985. The applicant in custody since 15.12.2023. His earlier application was dismissed by this Court vide order dated 08.01.2024 as withdrawn passed in Miscellaneous Criminal Case No.57847 of 2023.
As per the prosecution story, a discreet information was received on 13. 06.2020 about transportation of large quantity of poppy straw from Truck bearing Registration No. RJ-21-GB-7792. The police team reached to the spot and found the said truck but no one was found in it. After search, the police found 4 Quintal 40 Kg. of poppy-straw and 500 bags of Grams in the said truck. On the basis of this, the FIR was registered. After arrest of driver (Mahaveer) of the vehicle and upon his disclosure statement recorded under Section 27 of the Evidence Act, the present applicant has also been implicated in this case.
On 08.01.2024 this Court was not inclined to grant bail, therefore, the arguing counsel sought withdrawal of first bail application. There is no changed circumstances to re-consider the matter again.
Accordingly, the present application is dismissed.
