Order in Appeal from Order No.173 of 2023
Heard Mr. Devang Lathigara, learned counsel for the appellants and Mr. Indravadan Parmar, learned counsel appearing on caveat for the respondent.
Mr. Lathigara, learned counsel for the appellants, on instructions, does not press this appeal from order with a liberty to apply before the Court concerned for expeditious proceedings of the suit.
The appellant Hiraben Modi and others seems to be senior citizens.
Hence, the present appeal from order stands disposed of as not pressed with the aforesaid liberty. As and when application for early suit proceedings is filed, the Court concerned may consider the status of the appellants and decide the same in accordance with law.
It is clarified that, this Court has not examined the merits of the case.
