When the matter is taken up today, learned counsel for the petitioner Sri N. Krishna Murthy would submit that the docket order dated 12.09.2022 may be made as a final order in the writ petition with certain modifications to the effect that instead of granting two weeks time, six (6) weeks time may be granted to make a fresh representation and while enclosing the relevant documents, the petitioner may be permitted to submit a copy of judgment in W.P.No.6235(w) of 2002 of Hon’ble High Court of Kolkata for consideration of the respondent authorities.
Heard.
Having regard to the reasonability in the prayer, this writ petition is disposed of with the following order:
While advancing his arguments, learned counsel for the respondents Sri Sai Gangadhar Chamarty would submit that to his information the petitioner has not made any representation ventilating its grievance and filed writ petition and if a fresh representation is made, the same will be considered in accordance with the applicable law and rules and order will be passed in due course. In that view of the matter, petitioner is permitted to submit fresh representation to the respondents 1 and 2 by enclosing relevant documents including the copy of order in W.P.No.6235(w) of 2002 of Hon’ble High Court of Kolkata for consideration within six (6) weeks from the date of receipt of a copy of this order, in which case the respondents 1 and 2 shall consider the same and if necessary afford personal hearing to the petitioner and pass appropriate order within two (2) weeks from the date of submission of the representation.
As a sequel interlocutory applications if any pending, shall stand closed.
