Judgment
Rakesh Tiwari, J.—The Petitioner was appointed as Sahaika in Gram Sabha Sadosar, Block Kopaganj, District Mau on 20.7.2001.
The Petitioner has come up in this writ petition against advertisement for direct recruitment of Aganbari Karyakatri on the ground that advertisement has been issued without ascertaining the 25% promotional quota for promotion from Sahaika to Aganbari Karyaktri.
Learned Counsel for the Petitioner has relied upon the G.O. dated 6.12.2006. Para No. 1 of the Annexure No. 5 is as under:
He further submits that Bal Vikas Pariyojana Adhikari has also issued instructions to Block Officer to provide a list of Sahaika eligible for promotion as per the aforesaid G.O. dated 6.12.2006.
The contention of the learned Counsel for the Petitioner is that the advertisement does not specifically provide 25 % post for Sahaika, who may be considered for the post of Aganbari at block level.
The contention of the Counsel for the Petitioner appears to be without force as in the procedure for recruitment for selection of Aganbari, condition ''Ta'' it is provides that the aforesaid advertisement also includes 25 % vacancies of Aganbari Karyakatri to be filled up from Sahaika, it is as under:
In this view of the matter, no interference is required under Article 226 of the Constitution. If the Petitioner has applied for appointment for Karyakatri in pursuance of the advertisement being a Sahaika for the post of Aganbari then if she is found eligible she shall be alongwith others will be considered under the 25% post as provided in the advertisement, the G.O. dated 6.12.2006 and the procedure for recruitment for selection of Aganbari Karyakatri.
The writ petition is accordingly dismissed.
