The petitioner has challenged the advertisement dated 29.06.2026 issued by the respondent no.2 to the candidates belonging to OBC category in Aganwadi Kendra No.2 Naukaragrant @ Buggawala Block Bhagwanpur, District Haridwar; and further seeking a writ of mandamus commanding the respondents to promote/appoint the petitioner on the post of Aganwadi worker at Aganwadi Kendra No.2 Naukaragrant @ Buggawala Block Bhagwanpur, District Haridwar as per the Government Order dated 18.12.2024.

It is the case of the petitioner that the petitioner is working as an Aganwadi Sahayika for the last 18 years in Naukaragrant @ Buggawala. The post of Aganwadi Karyakarti fell vacant in another Aganwadi Centre known as Kendra No.2 Naukaragrant @ Buggawala, Block Bhagwanpur, District Haridwar. The said vacancy was reserved for the candidate belonging OBC by the respondent and an advertisement was issued on 29.06.2026 by the respondent no.2 for supplying the said vacancy.

It is contended by learned counsel for the petitioner that in view of the Government Order dated 18.12.2024, the post of Aganwadi Karyakarti of Aaganwadi Kendra No.2 Naukaragrant @ Buggawala cannot be advertised in view of the fact that the petitioner has got a right to be promoted against the said post being an Aganwadi Sahayika.

Learned State Counsel submits that the petitioner has got a right to be considered for promotion only when the post of Aganwadi Karyakarti is vacant in the same Aganwadi Centre where the petitioner is working as Anganwadi Sahayika. Since the petitioner is working as Aaganwadi Sahayika in another center and the post of Aaganwadi Karyakarti was advertised for the another Aaganwadi Centre i.e. Kendra No.2 Naukaragrant @ Buggawala, therefore, the petitioner has no right to be considered for promotion and accordingly the advertisement has rightly be issued.

Having heard the learned counsel for the parties and having perused the writ petition, this Court is of the view that the petitioner has no right in view of the statement made by the State Government relying the Government Order dated 18.12.2024. Since the petitioner is working in Naukaragrant @ Buggawala, while the vacancy was advertised in Aaganwadi Kendra No.2 Naukaragrant @ Buggawala, in such view of the matter, no interference is warranted. Respondents have rightly issued impugned advertisement dated 29.06.2026.

Accordingly, the writ petition is dismissed in limine.
