In pursuance of the earlier order dated 24.07.2024, Shri Sunil Bajpai, learned Additional Chief Standing Counsel files affidavit of compliance duly sworn by the respondent-Ms. Harshita Mathur, District Magistrate, Raebareli, which is taken on record.
Shri Sunil Bajpai, draws the attention of the Court towards the Annexure CA-1, which is the letter dated 09.08.2024 of Mr. Ram Keval, Special Secretary, Government of U.P., in which, it is informed that amount of Rs.50 lac has already been sanctioned. Thereafter, formal order has also been passed by the respondent-District Magistrate, Raebareli on 10.08.2024. Learned Additional Chief Standing Counsel also informs that the aforesaid amount will be transferred in the account of the legal heirs of the deceased employee within one week from today. It is, thus, submitted that as the order of the writ Court has been complied with, the application has lost its efficacy and may be dismissed.
Learned counsel for the applicant also concedes the aforesaid fact.
Considering the submissions of the learned counsel for the applicant, learned Standing Counsel and going through the order of the writ Court as well as contents of the affidavit of compliance, the application stands dismissed as infructuous.
However, it is open to the applicant to move a recall application, in case, the aforesaid amount is not transferred in the account of the applicant.
