Vijay Manohar Sahai, J.—I have heard Shri R.K. Mishra, learned Counsel for the petitioner and Ms. Chetna Shah, learned AGP for the respondents.

This Special Civil Application has been filed by the petitioner claiming that she was appointed as Kitchen Assistant on 21.12.1991 in the Hostel which is run by the Government. The petitioner has not brought on record any appointment letter to demonstrate that the petitioner was appointed after following due procedure prescribed by law. She claims that she was being paid consolidated salary of Rs. 1350/- p.m.

In reply, the respondents have filed an affidavit wherein they have annexed the Resolution of the Government dated 23.9.1998 which provides that the remuneration of Class-IV part time employees was revised to consolidated remuneration of Rs. 1350/- p.m. for the work upto six hours. The petitioner was being paid the same remuneration of Rs. 1350/- p.m. According to the petitioner she has been disengaged on 18.4.2001.

After some argument, Shri Mishra, learned Counsel for the petitioner stated that the petitioner may approach alternative remedy before appropriate Form.

In view of the statement made by Shri Mishra for the petitioner, this petition is dismissed with a liberty to the petitioner to seek her remedy in appropriate legal Forum. Rule is discharged, with no order as to costs.
