Judgment
Mehlab S. Gill, J.—The petitioner has filed a writ in the nature of certiorari for quashing the award dated September 15,1999 (Annexure P-1)pased by the Presiding Officer Labour Court, Hisar.
The petitioner has averred that respondent No. 2 was engaged as a Forest Guard on daily wages. He was incharge of the beat for different periods for carrying out plantation. Muster rolls were issued month to month by the competent authority for the work to be carried out. Respondent No. 2 was engaged on day-today basis as per requirement of work. He abandoned his job on November 9, 1995 and thereafter issued a demand notice u/s 10 of the Industrial Disputes Act, 1947 (hereinafter referred to as "the act").
We have herd teamed counsel for the petitioner, gone through the petition and perused the annexures attached therewith.
Shri Pawan Kumar, Forest Range Officer, came into the witness-box, as MW- 1. In his Examination-in-chief, he stated that respondent No. 2 had worked for 187 days during the period from June, 1994 to December, 1994. In his cross- examination, he admitted that respondent No. 2 had also worked during the period from January, 1995 to November, 1995 as per details given in muster rolls, exhibits W-l to W-9 an thus, he worked from 250 days during preceding 12 months from December, 1994 to November, 1995.
From the decomentary evidence of the muster rolls, Exhibits W-l to W-9, coupled with admission of MW-1 Shri Pawan Kumar, Forest Range Officer, it is clear that the respondent-workman had worked for 240 days in preceding 12 months. This period can be deemed to be continuous as per the provision of Section 25B of the Act. This services were terminated without giving him any notice or retrenchmenl compensation and thus, the petitioner violated the provisions of Section 25F of the Act.
For the reasons recorded above, we find no infirmity in the award dated September 15, 1999 (annexure P-1) passed by the Labour Court, Hisar and the petition is, thus, dismissed.
Petition dismissed.
