Heard Shri M. S. Saini and Shri P. S. Khare, learned counsel  for  the  applicants  and  Shri  R. N.  Singh  and  Shri Shailendra Tiwary, learned counsel for the respondents.

Learned counsel for the applicants submitted that the applicants appeared in the Departmental Competitive Examination and their result was declared on 06.12.2017 in which their names were included but subsequently on 29.05.2018, the respondents published another result on account of the fact that there were certain mistakes in the earlier result, and the result was cancelled. The respondents thereafter released a fresh result in which the names of the applicants were missing. The applicants immediately moved a representation on 30.06.2018 and also filed this OA on 31.05.2018. At the time of admission on 01.06.2018, the applicants were directed to implead the affected parties in the OA. The applicant thereafter moved MA No.2619/2018 for some interim directions.

Today, Learned counsel for the respondents has brought before this Bench an order dated 31.05.2018 by which the representations of the applicants were decided by a reasoned and speaking order in which it has been clearly stated that due to violation of rules, the candidature of the applicants were cancelled. A copy of the said order has also been handed over to learned counsel for the applicants.

At this stage, learned counsel for the applicants submitted that he may be given liberty to file a fresh OA challenging the order dated 31.05.2018 along with the other reliefs.

In view of the statement made by learned counsel for the applicants, the applicants are permitted to withdraw this OA with liberty to file a fresh OA. The OA stands dismissed as withdrawn. All ancillary applications stand disposed of.
