Harsh Chouhan vs State of Haryana

This original application was registered on the basis of the letter petition dated 03.03.2023 with the allegation of illegal cutting of trees using JCB and heavy machines during the course of illegal mining in Morni area of State of Haryana on the land belonging to the Forest Department appurtenant to the road especially with reference to Khasra No. 156 and 166.

The Tribunal by order dated 30.05.2023 had constituted a joint Committee comprising of State PCB, District Forest Officer, Panchkula, District Magistrate, Panchkula and Director, Mining and Geology, Haryana with a direction that the State PCB will act as a nodal agency and further direction to the Committee to visit the site, collect all relevant information and submit a factual report.

In compliance of the directions of the Tribunal, the joint Committee has submitted the report. The report of the Committee reveals that there was no evidence of illegal mining and illegal cutting of the trees. The land in Khasra No. 156 was found to be a private land and no illegal mining or felling of trees on the said land was found. So far as land in Khasra No. 166 is concerned that was found to be of the Forest Department. The PWD in its report also did not find any encroachment on the public road.

In view of the report of the joint Committee, we find that the allegations made in the letter petition are not substantiated and they are not being found to be true. Hence, no further action in the OA is required which is accordingly disposed of.
