Judgment
By Akhil Kumar Srivastava, JM:-Shri Aman Tamboli, learned counsel for the applicant and Shri Ramakant Mishra, Dy. Solicitor General who has accepted notice on behalf of the respondents, are present.
The matter is listed under the head of ‘Fresh Admission’. Same is heard and decided today itself with the consent of learned counsels appearing for both the parties.
By way of the instant original application filed under section 19 of the Administrative Tribunals Act 1985, the applicant has challenged the order dated 13.06.2023 passed by Senior Superintendent of Post Office, Durg (Respondent No. 4) whereby the applicant was given punishment of Removal from Engagement.
Learned counsel for the applicant submits that against the penalty order, the applicant has preferred appeal dated 06.07.2023 which is still pending before the appellate authority i.e. Respondent No.4/ Senior Superintendent of Post Office, Durg and the grievance of the applicant would be redressed if the appellate authority is directed to decide the same within a time bound manner.
On the other hand, Shri Ramakant Mishra, learned Dy. Solicitor General representing the respondents has raised no objection to the aforesaid prayer of the applicant.
Having regard to the innocuous prayer made by the learned counsel for the applicant, the OA is disposed of at the admission stage itself with direction to the Respondent no. 4 i.e. Senior Superintendent of Post Office, Durg to consider and decide the appeal of the applicant dated 06.07.2023 by a reasoned and speaking order within a period of 90 days from the date of receipt of certified copy of this order.
With the above direction, the OA is disposed of without going into the merits of the case.
All associate MAs, if any, stand disposed of.
No order as to costs.
