Judgment

Learned counsel for plaintiff submits that as per instructions imparted to him, matter has been settled between plaintiff and defendants and defendants have agreed for execution of sale deed in furtherance of agreement to sell in reference in present suit, subject to withdrawal of present suit, as compromised, prior to execution of sale deed and, therefore, he seeks permission to withdraw this suit as compromised with liberty to file afresh, if occasion arises.
Learned arguing counsel appearing for defendants, under instructions of instructing counsel, who have been duly instructed by original counsel to do so, has endorsed the agreement between the parties, as claimed by plaintiff and communicated no objection for allowing the prayer of the plaintiff.
In view of above, Civil Suit is permitted to be withdrawn on the basis of compromise arrived at between the parties with liberty to file afresh, if occasion arises.
Civil Suit is disposed of as withdrawn in aforesaid terms with liberty as prayed for, along with pending application(s).
Decree sheet be prepared accordingly.
Court fee be refunded to the plaintiff, as permissible under rules.
