MA No.1507/2020, filed by the applicants, seeking permission of this Tribunal to join in a single Application is allowed.
This OA if filed challenging the impugned order dated 29.10.2013 passed by the UGC, in so far as it appointed Respondent No.3 as Education Officer. The applicant contends that he secured more marks in the selection and despite that he was not selected.
We heard Sri.V.S.R. Krishna, learned counsel for the applicant and Sri S.N.Verma, learned counsel for the respondents.
The OA is filed in relation to the selections which took place way back in the year 2013. The ground urged by the applicant is that he was one of the applicants in OA.663/2014 and the relief therein was confined to applicants 1 to 5. He submits that he too is entitled for similar relief.
If the applicant figured as one of the parties to OA.663/2014, he has to work out the remedies vis-à-vis OA.663/2014. He cannot file a fresh OA. It becomes barred by time and latches.
Learned counsel for applicant seeks permission of this Tribunal to withdraw the OA with liberty to file a Review Application. We accord the permission and dismiss the OA as withdrawn, with liberty to file a Review Application in OA No.663/2014.
There shall be no orders as to costs.
