It appears that under order dated 21.11.2016, learned counsel for the petitioner relied on a document i.e. Letter No. 1271/15 issued on 03.07.2015 sent to the I.O of the case for making certain enquiries on the different points (I) Whether paddy was purchased through PACS, if yes (ii) the name of the farmers along with their address (iii) details of payment made to the farmers (iv) details of owners of the truck and weighing machine (v) details of paddy supplied. Learned counsel for the petitioner has submitted that he has received this document through R.T.I and learned counsel for the petitioner directed to serve two copies of aforesaid letter to the learned A.P.P within one week and learned A.P.P is directed to send it to the I.O and get the detail information about the fact as to whether I.O during course of investigation obtained information, if yes, whether he investigated on these points or not.

Further counsel for the petitioner was directed to furnish mobile number of the petitioner to the learned who shall furnish to the I.O want to record the statement of the petitioner he shall give 72 hours notice to the petitioner fixing the date, time and place to the petitioners, thereafter petitioner appear before the I.O and cooperate in the investigation. The matter was listed on 30.1.2017 an on that date required report was not produced and the matter was directed to listed on 02.03.2017. On that date learned A.P.P has informed that I.O of the case has been changed and the matter was listed on 22.03.2017. On 22.03.2017 I.O was directed to remain physically present before this Court on 15.06.2017 and also directed to stop the salary of the I.O of the case.

Today, when the case is called out, learned A.P.P has filed supplementary counter affidavit and learned A.P.P has submitted that he has received the up to date case diary, hence this matter will be heard separately.

List this case on 12.07.2017.

Till then, interim relief granted earlier shall continue.
