Judgment
Alok Singh, J.—This is an application seeking anticipatory bail in FIR No. 3 dated 5.1.2011 under Sections 420, 120-B of the Indian Penal Code, registered at Police Station Balongi, District Shahabjada Ajit Singh Nagar.
Learned Counsel for the Petitioner states that Petitioner is similarly situated as accused in connected case i.e. CRM-M-No. 7394 of 2011. Learned Counsel for the Petitioner further states that Petitioner shall join the investigation.
Mr. T.S. Salana, Deputy Advocate General, appearing for the State states that if Petitioner joins the investigation he can be considered for the anticipatory bail
Considering totality of the facts and circumstances of the case, petition is allowed. Petitioner is directed to report in the police station for joining the investigation within 10 days and on joining the investigation Petitioner shall be released on bail on furnishing his personal bond and one surety of Rs. 20,000/- each to the satisfaction of the Arresting Officer, subject to the following conditions:
(i) that he shall make himself available for interrogation by a police officer as and when required;
(ii) that he shall not directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him fro disclosing such facts to the Court or to any police officer ;
(iii) that he shall not leave India without the previous permission of the Court.
