The appellant seeks grant of anticipatory bail under Section 438 Cr.P.C in case bearing FIR No.08 dated 16.02.2024 registered under Sections 384/323/148/149 IPC and (Section 3 of SC/ST Act added later on vide Rapat No.29 dated 02.03.2024) at Police Station Lakho-ke-Behram, District Ferozepur.
The learned counsel for the appellant submits that in compliance of the order dated 29.05.2024, the appellant has joined the investigation to the entire satisfaction of the Investigating Officer.
A reply dated 25.07.2024 by way of an affidavit of Atul Soni, PPS, Deputy Superintendent of Police, Sub Division, Guruharsahai has been filed on behalf of the State by the learned counsel for the State. The same is taken on record. He on instructions admits the aforesaid fact and submits that the appellant is no more required for further investigation in the case.
In view of aforesaid factual position, the interim order dated 29.05.2024 is made absolute. However, the appellant shall keep on joining the investigation as and when required to do so and he shall abide by the conditions as envisaged under Section 438(2) Cr.P.C.
The appeal stands disposed of.
