Judgment
In this Original Application, the applicant, who is stated to be a resident of Model Town Ludhiana has raised the grievance about use of a spot near Bhai Chattar Singh Park, Model Town Ludhiana for the purpose of collection of garbage. Further issue raised by the applicant is about the slip road and the area below the railway over bridge adjoining the park for storing garbage.
The record reflects that same applicant had earlier approached the Tribunal with OA No. 191/2020, Gurinderpreet Singh & Ors. vs. State of Punjab & Ors., raising the same issue. The reports by the State PCB dated 12.02.2021 and the report of the Monitoring Committee constituted by this Tribunal headed by Justice Jasbir Singh, former Judge of Punjab & Haryana High Court dated 17.02.2021 were filed covering both the issues. After considering the reports the Tribunal on 04.03.2021, with certain observations, had disposed of the OA.
Once at the instance of the same applicant, same issue is considered and decided by the Tribunal by disposing of the OA with certain observations, then for the same cause, unless there is change in the circumstances, no fresh OA can be maintained. If the applicant has any grievance in respect of non-implementation of the order passed by the Tribunal earlier, then he can avail such other remedies as are available in law.
The OA is accordingly dismissed.
