Judgment
Jaswant Singh, J.—Prayer u/s 438 Cr.P.C is for grant of anticipatory/pre arrest bail in case FIR No. 87 dated 21.3.2010 under Sections 306/34 IPC, P.S Pehowa, District Kurukshetra.
Petitioner is Jija of Jaswinder Singh husband of deceased Pinky. As per allegations in the FIR, the husband Jaswinder Singh was a drunkard and used to give beatings to his wife Pinky. Since last two years, he had developed illicit relations with one Kailasho. It is alleged that the Petitioner was supportive of Jaswinder Singh in the atrocities committed by him towards Pinky. On the day of occurrence i.e 16.3.2010 husband Jaswinder Singh is alleged to have given beatings resulting into his wife Pinky jumping into canal to her inevitable death.
Learned Counsel for the Petitioner submits that the main accused Jaswinder Singh has been granted bail whereas the allegations in the FIR do not constitute any offence against the Petitioner.
Learned state counsel, on instructions from ASI Sartaj Singh, states that the Petitioner has joined investigation and his custodial interrogation is no longer required.
In view of the above, interim protection/bail granted vide order dated 27.10.2010 is made absolute.
Petition stands disposed of.
