The petitioner is one of the accused persons in FIR No.80/2021, dated 16.06.2021, registered under Section 20 and 29 of the Narcotic Drugs and Psychotropic Substances Act, 1985, at Police Station Padhar, District Mandi, H.P. The FIR in respect of recovery of 8 k.g. 490 gram of cannabis. The petitioner seeks his enlargement on regular bail
2 The previous bail petition moved by the petitioner bearing Cr.MP(M) No.1281/2022 was dismissed on merits vide order dated 24th June, 2022.
The only submission raised by the learned counsel is that the petitioner is inside the jail for about two and half years. No other change in the circumstances, much-less substantial change from the ones noticed in the order passed on merits dismissing petitioner’s previous bail petition has been pointed out. Learned counsel for the petitioner has himself stated that the trial of the case is in progress and evidence is being recorded.
In view of above, no case for allowing this petition is made out. Accordingly, the instant petition is dismissed. However, liberty is reserved to the petitioner to file a fresh petition, at an appropriate stage, in accordance with law. Pending miscellaneous application(s), if any, shall also stand disposed of.
