Today, this case is listed under the caption for "Extension of Time for Lower Court".
It is seen from the records that this Court, vide order dated 22.03.2022, directed the learned Judge of Family Court, Nagercoil, to dispose of the suit in O.S.No.102 of 2021 within a period of three months from the date of receipt of a copy of that order and at the request of the Family Court, three months further time was granted, vide order dated 29.08.2022 and thereafter, four months further time was given, vide order dated 16.12.2022 and thereafter three months time was granted as last opportunity, vide order dated 07.06.2023.
The learned Sessions Judge, Fast Track Mahila Court, Nagercoil, holding Full Additional Charge of the Family Court, Nagercoil, has submitted a requisition dated 04.10.2023 stating that the suit in O.S.No.102 of 2021 was posted for arguments and at that time, application came to be filed in I.A.No.1 of 2021 for furnishing security, that when the said petition after arguments posted for orders, the then Presiding Officer was transferred, that after taking the charge on 12.09.2023, he suo moto reopened the I.A.No.1 of 2021 and heard the arguments of the petitioner and posted for respondent's side arguments and that three months further time may be granted to dispose of the suit.
As already pointed out, this Court, vide order dated 07.06.2023, has granted three months further time as last opportunity to dispose of the suit. Despite the specific direction, the order was not complied with. Hence, the present Judge of the Family Court, Nagercoil, is hereby directed to dispose of the suit in O.S.No.102 of 2021 within a period of two months from today (18.10.2023).
