This is an application filed by the petitioner seeking a direction upon the respondents to grant enhancement of electrical load up to 1000 KVA in favour of the petitioner.
Heard learned counsel for the parties and perused the material on record.
Through the medium of the main writ petition the petitioner has challenged demand charges as surcharge made upon it for the period December 2009 to June 2013. It appears that vide interim order dated 24.03.2016, the respondents were directed to continue the power supply to the petitioner’s unit subject to deposition of Rs. 10.00 lacs before the Registry of this Court to be kept in the FDR. Along with the application, the petitioner has annexed communication dated 12.12.2022 addressed by Assistant Executive Engineer, Pampore to the Executive Engineer, KPDCL, Division, Awantipora recommending enhancement of load in favour of the petitioner. It is being submitted that no decision has been taken by the respondents on the basis of the said recommendation.
In view of the aforesaid facts and circumstances, a direction is issued to the respondents to consider the case of the petitioner for enhancement of load in light of the rules and Bylaws holding the field and take a decision by next date of hearing. List the main matter on 06.03.204.
