Judgment
Heard Mr. Sumeet Gadodia, learned counsel for the petitioner and Mr. Piyush Chitresh, learned AC to Advocate General appearing for the respondents-State
The petitioner files the batch of writ petitions challenging order as contained in Memo No. 914/M dated 11.05.2023 [in WPC No. 3051 of 2023]; Memo No. 917/M dated 11.05.2023 [in WPC No. 3052 of 2023]; Memo No. 918/M dated 11.05.2023 [in WPC No. 3053 of 2023]; Memo No. 916/M dated 11.05.2023 [in WPC No. 3054 of 2023]; Memo No. 915/M dated 11.05.2023 [in WPC No. 3055 of 2023]; issued by respondent no. 4 wherein the petitioner in alleged exercise of power under Rule 54(6) of the Jharkhand Minor Mineral Concession Rules, 2004 has been directed to make payment of penalty/royalty, as mentioned in the respective impugned memo; and has further been directed to make payment of penalty of Rs. 2000/- for alleged incorrect filing of Return.
Mr. Sumeet Gadodia, learned counsel for the petitioner has contended that the matter is fully covered by the judgment of this Court passed in the case of J.K. Bricks through its proprietor Ramdas Sahu & Ors. Vs. State of Jharkhand & Ors. reported in 2023 SCC OnLine Jhar 2023.
Mr. Piyush Chitresh, learned AC to Advocate General appearing for the State has contended that the matter may be disposed of in terms of the judgment passed in J.K. Bricks through its proprietor Ramdas Sahu & Ors. Vs. State of Jharkhand & Ors. (supra).
Accordingly, in terms of the aforesaid judgment, as referred above, the instant writ petitions stand disposed of.
Pending Interlocutory Applications stand disposed of.
