Judgment
Alleging inaction on the part of respondent No.3 in conducting investigation subsequent to registration of Crime No.83 of 2023 of Afzalgunj Police Station, Hyderabad District, this Writ Petition has been filed.
It is submitted that when the complaint of the petitioner was not considered by the respondent police, the petitioner has filed a private complaint and the same was referred to by the II Additional Chief Metropolitan Magistrate, Hyderabad, vide order dt.14.02.2023 in SR No.5539 of 2022, to the respondent police for investigation. However, no enquiry was made thereafter and no investigation was conducted and therefore, this Writ Petition has been filed.
Learned Assistant Government Pleader for Home, along with written instructions, has filed a final report stating that the complaint of the petitioner has been closed on account of lack of evidence.
Learned counsel for the petitioner submitted that though it is stated that the final report is dated 30.08.2023, the information has been given to the petitioner vide communication dt.18.12.2025 and therefore, it is illegal and arbitrary.
However, this Court finds that against the closure of the complaint, the petitioner has legal remedy of filing a protest petition before the Criminal Court concerned as it involves verification of facts.
Therefore, this Writ Petition is closed with liberty to the petitioner to approach the Criminal Court concerned if she is aggrieved by the closure of her complaint. No order as to costs.
Pending miscellaneous petitions, if any, in this Writ Petition shall also stand closed.
