The case of the prosecution is that, on 15.09.2026 the defacto complainant's husband went to bring bamboo sticks from his land situated near the accused's land and the accused said to be claimed that he has installed electric fence by taking illegal electricity connection in order to protect his agricultural crops from wild animals and that due to electrocution the husband of the complainant died on the spot and on intimation given by one Parthiban, she rushed to the occurrence spot and found the deceased person with burn injuries on his legs. Hence, the case.
The learned counsel appearing for the petitioner submitted that the petitioner has been falsely implicated in this case and the petitioner is in judicial custody since 15.09.2026; and that the petitioner is ready to abide by any stringent conditions that may be imposed by this Court and sought for bail to the petitioner.
Per contra, the learned Government Advocate (Criminal Side) appearing for the Respondent Police reiterated the prosecution case, the deceased was dead due to electrocution from illegal electric fence installed in accused's land. Hence, he opposed to grant bail to the petitioner.
I have given my anxious consideration to either side submissions and perused the materials available on record.
Considering the facts and circumstances of the case, the deceased was dead due to electrocution from illegal electric fence installed in accused's land, it is the unapproved electric fence and it is seen from the FIR there is no sign board, this Court is of the firm view that the petitioner is not entitled to be enlarged on bail, this Court is not inclined to grant bail to the petitioner at this stage.
Accordingly, this Criminal Original Petition is dismissed.
