This writ petition is filed under Article 226 of the Constitution of India seeking to declare the action of the 2nd respondent in issuing the impugned letter Lr.No.NIL/2021, dated 30.12.2021 addressed to the petitioner refusing to register the document in relation to ‘Swarna Krishna Residency’ bearing D.No.13-85/5, Flat No.SF-1 located in RS.No.430/7 of Poranki Village, Penamaluru Mandal, Krishna District on the ground that the same is covered under the injunction order passed by the II Additional District Judge, Vijayawada in I.A.No.763/2009 dated 31.3.2012 in O.S.No.59/2006 is illegal, arbitrary and with non-application of mind and set aside the same and further direct the 2nd respondent to receive and register the document to be presented in relation to the subject property.
During the course of hearing, learned counsel for the petitioner submitted that the subject matter of this writ petition is squarely covered by the order of this Court dated 22.3.2019 passed in W.P.No.2616 of 2019.
Learned Government Pleader did not oppose the said submission.
In view of the submission of the learned counsel for the petitioner and the learned Government Pleader appearing for respondents, this writ petition is disposed of in terms of the order dated 22.3.2019 passed in W.P.No.2616 of 2019. Accordingly, the 2nd respondent is directed to receive, register and release the document presented by the petitioner in respect of the subject property without reference to the order dated 31.3.2012 in I.A.No.763/2009 in O.S.No.59/2006 on the file of the learned II Additional District Judge, Vijayawada, provided the same is not included in the list of prohibited properties.
Registry is directed to annex a copy of the order dated 22.3.2019 passed in W.P.No.2616 of 2019.
Miscellaneous petitions, if any, pending in this petition shall stand closed.
