Gopi Singh Bragta vs State of H.P. and Others

Kurian Joseph, C.J.—The writ petition is filed with the following prayers:

(i) That the Respondents be directed to give the applicant the appointment of Supervisor from the date of his entitlement as per the compromise Annexure A-1.

(ii) That the Respondents be also further directed to grant back date seniority to the applicant and regularization of his services as Supervisor in the Respondent department.

Placing reliance on Annexure A-1 compromise filed before the Labour Court, it is submitted that as and when the vacancy for the post of Supervisor arose, the Petitioner should have been offered the appointment. According to the Petitioner, vacancies arose after the compromise and without considering the claim of the Petitioner based on Annexure A-1, several juniors had been offered appointments. In the reply, it is stated that the Petitioner had not made any representation.

In the above circumstances, the writ petition is disposed as follows. In the event of the Petitioner filing an appropriate representation furnishing all the particulars before the first Respondent within a period of one month from today, the matter will be duly considered by the first Respondent and appropriate order, adverting to the submissions made in the representation, will be passed within another four months. In case the petition seeks opportunity of personal hearing, the same shall also be granted to him.

The writ petition is disposed of, so also the pending application(s), if any.
