Narendra Nath Tiwari, J.—The Petitioner, in this writ petition, has prayed for quashing the Separation Order No. 29716/O dated 5th June, 2010 issued under the signature of Respondent No. 4, as contained in Annexure-5, whereby the Petitioner has been dismissed from the services of the Company with immediate effect. The Petitioner has also prayed for his reinstatement in service with all consequential benefits.

The grievance of the Petitioner is that the Petitioner has been sought to be dismissed from service without issuing any show cause notice and without observing the principles of natural justice. No departmental proceeding has been initiated against the Petitioner till date. The Petitioner has further stated that he has preferred appeal before the appellate authority-Respondent No. 2 under Clause 41 of the Standing Order as far back as on 10th June, 2010, but till date the Petitioner''s appeal has not been considered and disposed of by the concerned authority.

Learned Counsel appearing on behalf of the Respondents submitted that the Petitioner''s appeal shall be considered and disposed of by the appellate authority without any further delay.

In view of the said submissions made by learned Counsel for the parties, this writ petition is disposed of, directing the Managing Director, Bokaro Steel Plant, Bokaro (appellate authority)Respondent No. 2 to dispose of the Petitioner''s appeal, following the procedure laid down in the certified standing order, in accordance with law, within a period of six weeks from the date of receipt/production of a copy of this order.

It goes without saying that the said Respondent after taking decision shall communicate the same to the Petitioner in writing.
