Facts

The petitioner filed a writ petition questioning the action of the respondents in not releasing his retiral benefits despite token numbers having already been raised by the respondent authorities for payment of the amounts payable to him. The petitioner submitted that the lis raised in the writ petition had already been adjudicated by the Division Bench of this Court in W.P.No.23138 of 2025, disposed of by order dated 03.09.2025, and sought a similar order. The learned Assistant Government Pleader for Services-III did not dispute that submission and stated that the respondents would release the amounts on a priority basis according to the token numbers. With the consent of the parties, the writ petition was taken up for disposal at the stage of admission itself.

Law Points

Acts & Articles

Constitution of India, Article 226; Code of Civil Procedure, Section 151 (as listed in the Acts on record).

Judgments Referred

W.P.No.23138 of 2025, order dated 03.09.2025 (Division Bench of this Court): the petitioner relied on it and sought a similar order; the Assistant Government Pleader did not dispute its disposal; this Court disposed of the present writ petition for reasons alike and issued similar directions.

Obiter Dicta

Not discussed in this judgment.

Ratio Decidendi

Where retiral benefits are payable to the petitioner and token numbers have already been raised by the respondent authorities, the respondents are required to release the entire amount expeditiously, preferably within six weeks; if they fail to do so, the entire amount towards retiral benefits shall carry interest at 10% per annum from the date the amount fell due till the actual date of payment.

Final Ruling

The writ petition was disposed of directing the respondents to ensure that the entire amount payable to the petitioner is released as expeditiously as possible, preferably within six weeks from the date of the order, failing which the entire amount with regard to the retiral benefits shall carry interest at 10% per annum from the date the amount fell due till the actual date of payment. Miscellaneous petitions pending, if any, were closed, and there was no order as to costs.

Plain-Language Gist

The petitioner complained that his retirement benefits were not paid even though the authorities had already raised token numbers for payment. The High Court directed the respondents to release the entire amount as early as possible, preferably within six weeks, and said that if payment is delayed beyond that, the retiral benefits will carry interest at 10% per annum from the date they fell due until actual payment.
