Judgment
The Learned Representative for the Petitioner is present.
MA 3584/2019 is filed by the RP. Seeking for initiating Liquidation of the Corporate Debtor. The COC vide meeting on 27.08.2019 has resolved that "RESOLVED THAT consent of the Members of the COC of the Corporate Debtor be and is hereby accorded to proceed for Liquidation of the Corporate Debtor i.e. Evershine Advisory Services Private Limited under Section 33(2) of the Insolvency and Bankruptcy Code, 2016, subject to the approval of the Adjudicating authority."
The RP has consented to be appoint as a Liquidator. Further the COC has also approved that Rs. 6 lacs be paid to the Liquidator and a cost of Rs 4 lacs to be paid as out of pocket expenses under section 59 of I&B Code.
In view of the said resolution being passed the MA is allowed and Liquidator has appointed as approved by the COC.
