Judgment
The order passed by the Fee Revision Committee in an application under Section 12 (3) of the Gujarat Self-Financed Schools (Regulation of Fees) Act, 2017 is the subject matter of the above Special Leave Petition (SLP).
Dr. Singhvi relied upon an order passed by this court on 01.02.2018 to justify the filing of the SLP against the Fee Revision Committee without approaching the High Court.
By an order dated 01.02.2018, this Court directed the State of Gujarat to re-constitute the Fee Fixation Committee and the Revisional Authority. Regarding the working out of the order dated 01.02.2018 grievances were to be made only to this Court and not to any other Court.
The Fee Fixation Committee and the Revision Committee were constituted as per the directions of this Court. The order passed by the Fee Fixation Committee was affirmed by the Revision Committee by an order dated 30.04.2019. The bar imposed on all the other Courts, entertaining any grievance pertaining to the working out of the order dated 01.02.2018 cannot be made applicable to a challenge to a final order passed by the Revision Committee.
The Petitioner is permitted to withdraw the Special Leave Petition and seek redressal of his grievance before the High Court.
The Special Leave Petition is, accordingly, dismissed as withdrawn.
