Judgment
S.R. Brahmbhatt, J.—Rule. Learned AGP Ms. Manisha Narsinghani waives service of notice of rule for Respondent Nos. 1, 2 and 3 and learned advocate Shri Dilip B. Rana waives service of notice of rule for Respondent No. 4. Rule is fixed forthwith, as requested by learned advocates appearing for the parties as the controversy was in narrow compass.
The sole contention of the learned advocate appearing for the Petitioners was that the order impugned was not clear as to whether the Revision Application being Revision Application No. 296/2010, preferred by Respondent No. 4 is still pending and awaits its final disposal or it is disposed of as could be seen from the order impugned. This submission was made yesterday i.e. on 28.03.2011. Learned AGP was to seek instructions on this. Today she has placed on record the communication received from the author of the order indicating clearly that the Revision Application No. 296/2010 is still pending.
In view of this, learned advocate Shri B.S. Patel for Petitioners prays for withdrawing the petition without adverting to various contentions for challenging the petition.
At this stage learned advocate Shri Rana for Respondent No. 4, submitted that the Petitioner No. 1, Marketing Committee shall cooperate in the hearing and furnish the details called for by the Director vide his communication dated 20.09.2010 and 24.11.2010 or any information that may be requested thereafter.
In view of the aforesaid submission, permission as sought for withdrawing the petition is granted. The petition is disposed of as withdrawn. The Court has not opined on the merits of the matter.
Shri Patel at this stage submitted that the Petitioner No. 1 shall cooperate with the hearing of the Revision Application and Marketing Committee will do all endeavor to furnish the requisite information with documentary evidences to the Director as and when called for and which have been already requested. In view of that the concerned authorities shall decide the matter as expeditiously as possible so that the appropriate decision in the interest of justice be arrived at. Rule is discharged. No costs.
