Judgment
K.M. Joseph, J.—Petitioner has approached this Court seeking the following the following relief:
Issue a writ of mandamus or any other appropriate writ, order or direction, directing respondents 2 to 6 to render adequate police protection to the petitioner and his team members of the Jesus Boat Club during the Nehru Trophy Boat Race scheduled to be held on 13-08-2010 at the Punnamada Lake, Alappuzha, especially while rowing the boat between the starting point and the 800 meter point at Kurissadi and to take effective steps to prevent any obstructions to the rowing of the boat by the petitioner''s team that may be caused by any miscreants.
Learned Counsel for the petitioner submits that the date mentioned as 13.08.2010 is an error and the event is to take place on 14.08.2010.
Briefly put, the case of the petitioner is as follows:
Petitioner is the Captain of Jesus Boat Club, the first prize winner of Nehru Trophy Boat Race for the years 2008 and 2009. This year also the Club is contesting. Petitioner relies on Ext.P1 Certificate. It is stated that the seventh respondent is a Body conducting Nehru Trophy Boat Race. It is alleged that during the Nehru Trophy Boat Race held in 2008 and 2009, the petitioner''s team which rowed the Karichal Chundan Boat was obstructed by some unidentified miscreants of the locality. They pelted stones at the Boat and struck the petitioner''s boat with wooden logs and also scattered plantain inside the track of the petitioner''s boat. Petitioner''s Club employs outsiders for rowing the boat which invited the wrath of local miscreants. It is stated that the obstructions are made between the starting point and 800 metre point at Kurissadi. The track has a length of 1260 metres. Petitioner submitted Ext.P2 petition for which Ext.P3 receipt is issued.
Learned Government Pleader on instructions would submit as follows:
The President is the Chief Guest of this function. The security arrangements will be supervised by seven Superintendents of Police and forty-seven Circle Inspectors of Police and a large number of other Police Officers. It is pointed out that the petitioner has not pointed any persons who have obstructed. It is further submitted that, however, on either side of the track, sufficient number of Police Officers will be patrolling in Boat to prevent any intrusion into the track. We record the submissions and dispose of the Writ Petition.
