Judgment
A. Badharudeen, J
Heard the learned counsel for the petitioners on admission.
In this case, the petitioners were granted bail by the Sessions Court, Kollam in Crime No.721/2022 of Anchalammoodu Police Station, in Crl.M.C.No. 1589/2022. It is submitted that, a petition was filed as Ext.P7 has been pending before the Sessions Court to lift the condition No.2. However, the prayer herein is as follows:
A. Pass and order by dispensing the personal appearance of the petitioners as per the Ext.P1 until Ext.P7 is considered and disposed off by the Hon'ble Sessions Court, Kollam.
B. Pass such other orders as this Hon'ble Court deems fit.
It appears that, as per order dated 27.09.2022, the learned Sessions Judge granted bail to the petitioners by imposing condition No.2 to the effect that the petitioners/accused shall appear before the Investigating Officer on every Monday between 9 a.m. and 11 a.m. for a period of two months.
Now, it is submitted that, petition as Ext.P7 has been pending before the Sessions Court to lift the condition No.2. Therefore there shall be a direction to the learned Sessions Court to hear and dispose of the same, on merits, within a period of seven days from the date of receipt of a copy of this judgment.
It is specifically ordered that, the petitioners shall obey condition No.2, without fail, till the said condition is either lifted or modified by the Sessions Judge. If the petitioners fail to obey condition No.2 till the disposal of Ext.P7, the same is reckoned as violation of condition No.2 in the bail order, for which, legal consequence will follow.
Accordingly this original petition is disposed of as above.
Registry is directed to forward a copy of this order to the Sessions Court for information and compliance within seven days.
