Judgment
I.A. No. 3754 of 2011
The order dated 22nd December, 2011 may be referred.
Mrs. Ritu Kumar submitted that the appellant has prepared four drafts on account of monthly maintenance at the rate of Rs. 3500/-per month from July, 2011 till December, 2011. One is of Rs. 10,500/-and other three are of Rs. 3500/- each.
Let a photo copy of the drafts be kept on record.
Mr. Atanu Banerjee submitted that the appellant has been sending maintenance amount to the respondent but without any reason, the appellant disobeyed the orders and therefore the respondent had to move this Court twice and incurred expenses apart from harassment and therefore the respondent is entitled to cost also.
On this, Mrs. Ritu Kumar submitted that the appellant undertakes to comply with the orders of this court by sending the monthly maintenance to the respondent every month, by registered post on her address, without fail.
We are inclined to impose a token cost on the appellant to the tune of Rs. 1,000/- ( One thousand only), which should be paid by bank draft.
The appellant is directed to send all the five drafts to the respondent on her address by registered post, within one week.
I.A. stands disposed of.
On being asked, Mrs. Ritu Kumar, on instruction of the appellant, said to be present in Court, submitted that he is ready for mediation.
Mr. Banerjee agreed to this.
Accordingly, the parties are directed to appear before the learned Secretary, District Legal Services Authority, Bokaro at 11 A.M. on 9th February, 2012 personally and not through lawyer. They are directed to cooperate in the proceedings.
Put up this case on 12th March, 2012 awaiting the report from Secretary, D.L.S.A., Bokaro.
