This writ petition has been filed under Article 226 of the Constitution of India for a direction to the respondents to dispose of First Appeal No. 2 of 2023 which has been preferred before the Jharkhand State Consumer Dispute Redressal Commission, Ranchi against the order dated 16.06.2023 passed by the President District Consumer Forum, Jamshedpur in Consumer Case No. 189 of 2006, whereby and whereunder a direction has been made to pay Rs. 5,01,260/- with interest for deficiency in service.
It is submitted by the learned counsel on behalf of the petitioners that as the post of President of Consumer Forum has not been filled up, therefore the Consumer Forum’s intent and purpose has become defeated and appeals are not being heard and, in the meantime, non-bailable warrant are being issued against the petitioners in execution proceeding for the compensation ordered against the petitioners.
Learned counsel on behalf of the State does not dispute the factual assertion so far as the state of affair in the State Consumer Forum is concerned.
Considering the submissions, the execution proceeding arising out of Consumer Case No. 189 of 2006 is stayed till the President of State Consumer Forum is appointed and the appeal preferred by the petitioners is taken up for hearing.
State authority is directed to take steps for appointment of the President of State Consumer Forum, Jharkhand, Ranchi.
Writ petition accordingly stands disposed of. I.A. No. 3539/2025 also stands disposed of.
Let a copy of this order be communicated to the Chief Secretary, State of Jharkhand for its compliance.
