Judgment

Heard learned counsel for the parties.
The present writ petition has been filed against the orders dated 20.09.2018 (Annex.5) and 28.09.2018 (Annex.7) passed by the Courts below, whereby the application for temporary injunction has been dismissed.
Learned counsel for the parties are in agreement that the interim order in the present case was passed on 04.10.2018 and the same is continuing till date, therefore, learned trial Court may be directed to decide the pending suit at the earliest and till the suit proceedings are decided, the interim order dated 04.10.2018 passed by this Court may continue.
Considering the submissions made by learned counsel for the parties, the present writ petition is disposed of with a direction to the trial Court (learned Civil Judge & Metropolitan Magistrate, Jodhpur Metro) to decide the pending suit No.88/2018 at the earliest preferably within a period of eight months from today and till the suit is decided, the interim order passed by this Court on 04.10.2018 shall continue.
