This petition coming up for orders on this day, upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of M/S.M.SOLAISAMY, Advocate for the petitioner and of Mr.B.NAMBISELVAN, Additional Public Prosecutor on behalf of the Respondent No.1, the court made the following order:-
This petition has been filed, on the ground that Crl.O.P(MD) No.13408 of 2020 that was filed by the co-accused was allowed by this Court, considering the fact that the petitioner was a college going student.
2.. Considering the fact that the petitioner is working as a Teacher, let the above said trial process be kept in abeyance and personal appearance of petitioner is dispensed with before the concerned trial Court on the following condition;
(i) The petitioner shall appear before the learned Judicial Magistrate, Rajapalayam, within a period of 15 days from the date of receipt of a copy of this order and file an undertaking affidavit, by affixing his recent passport size photograph, to the effect that he will appear before the trial Court as and when required and must ensure his proper representation through Advocate.
Issue notice to the second respondent returnable by 10.07.2023. Private notice is also permitted.
