Judgment
The writ petition was preferred for directing the respondent authorities to pay a sum of Rs. 2,29,830/- with interest thereon on the basis of the order dated 14th July, 2000 passed by the Presiding Officer, Labour Court, Deoghar in Miscellaneous Case No. 1 of 1999 and the Award-dated 28th December, 1992 in Reference Case No. 10 of 1980. It appears that the petitioner has taken initiative in the proceeding u/s 33-C(2) of the Industrial Disputes Act, 1947 for execution of the Award dated 28th December, 1992 before the competent Labour Court at Deoghar. The petitioner, at the same time, chose to invoke the writ jurisdiction of this court under Articles 226 & 227 of the Constitution of India. However, such parallel remedy cannot be pursued at the same time. Counsel for the petitioner therefore submits that the petitioner may be allowed to pursue his remedy before the appropriate Labour Court for execution of the Award/Order as aforesaid or any other proceeding available under the law.
This writ petition is disposed of with the aforesaid liberty.
