Judgment
Mr. Ganesh Chand Sharma had filed O.A. No. 330/2022 seeking the relief of issuance of directions to the respondents not to construct Taradi-Dhabra Shashikhal Motor Marg above the Naula of Village Malla Dhadhariya and to adopt alternate route to protect it from damage.
The above said application was disposed of vide order dated 25. 05.2023 and the relevant part of the order reads as under:

“13. In view of above the application is disposed of with the direction to the respondents to comply with the recommendation made in the Technical Report submitted by Dr S.K. Bartarya, Retired Senior Scientist (Hydrogeologist), Wadia Institute of Himalayan Geology, 30/10 Mohit Nagar, GMS Road Dehradun, Uttarakhand and execute modified proposal of road alignment accordingly within six months and the Executive Engineer, Provincial Division (PWD), Ranikhet, Government of Uttarakhand is directed to file Action Taken Report in this regard on or before 30.11.2023 by e-mail at [email protected] preferably in the form of searchable PDF/OCR Supported PDF and not in the form of Image PDF before the Learned Registrar General of this Tribunal, who may, if so considered necessary, direct the matter to be listed before this bench for further directions in the matter.

Report by way of affidavit of Mr. Onkar Pandey, Executive Engineer, Provincial Division, Public Works Department, Ranikhet, District Almora, Government of Uttarakhand has been filed vide email dated 30.11.2023.
The matter has been listed before the Bench under orders of learned Registrar General of this Tribunal for reviewing the execution and progress.
We have gone through the report. In the report it has been mentioned that proposal for amended alignment was approved by Superintendent Engineer, 1st Circle, Public Works Department, Almora and the work of construction of the road as per amended alignment in accordance with the recommendations of Dr. S.K. Bartrya is under process which is likely to be completed by the end of February 2024.
Mr. Rahul Verma, learned Additional Advocate General for the State of Uttarakhand has submitted that the construction of the road has already been completed.
In view of the above, no further action is required to be taken in the matter and M.A. No. 16/2024 is disposed of accordingly.
