This petition is filed under Section 438 of the Criminal Procedure Code, 1973 seeking to grant anticipatory bail to the petitioner herein/accused, in the event of his arrest in Crime No.40 of 2023 of Tenali Railwaypolice station, Nandyala District, registered for the offence punishable under Section306 I.P.C.

The case of the prosecution is that the petitioner/accused is the husband of the deceased. The deceased by name Guttikonda Nirmala Raniwas suffering from health issues like Diabetes and that there were financial problems in their house. On 12.04.2023, the deceased was found missing from her house, the petitioner/accused and his relatives searched for her. On 14.04.2023, the petitioner/accused received a phone call from his wife stating that she was going to consume poison at Tenali Railway station. Immediately petitioner/accused went there and shifted her to Government Hospital, where the duty doctor declared her brought dead. Initially the crime was registered under Section 174 Cr.P.C. During the course of investigation, on the complaint of sister of the deceased, the Section of law was altered to 306 I.P.C. Hence, the crime.

Heard Sri RambabuKoppineedi, learned counsel for the petitioner and learned K.Anand Kumar, learned Assistant Public Prosecutor, appearing for the respondent-State.

Learned counsel for the petitioner submits that the petitioner was falsely implicated in the present crime and prays to grant anticipatory bail to the petitioner/accused.

Learned Assistant Public Prosecutor opposed to grant pre-arrest bail to the petitioner.

Perused the record. It reveals that the contents of complaint given by the sister of the deceased show that due to the harassment of the petitioner/accused, the deceased committed suicide. As the allegations made against the petitioner/accused are grievous in nature, this Court is not inclined to grant pre-arrest bail to the petitioner/accused.

Accordingly, the Criminal Petition is dismissed.

As a sequel, miscellaneous applications pending, if any, in this Criminal Petition shall stand closed.
