1) Heard Sri K.K.Komalan, learned counsel for the Petitioner/Accused No.1 and learned Assistant Public Prosecutor representing the State.

2) This is an application filed under Section 438 of Code of Criminal Procedure, 1973 [‘Cr.P.C.’], to enlarge the Petitioner/Accused No.1 on anticipatory bail, in the event of arrest by the Police, in Crime No.29 of 2023 of Pedabayulu Police Station, Visakhapatnam District.

3) Learned Assistant Public Prosecutor on instructions would submit that as per the enquiry made by the police, the petitioner/accused No.1 was met with an accident and he would bed ridden since long time and not in a position to move anywhere. It is undisputed fact that A2, A3 and A4 were already enlarged on bail by the learned trial Court.

4) Considering all these circumstances, the Petition is allowed and the Petitioner/Accused No.1 shall be enlarged on anticipatory bail, in the event of his arrest, in Crime No.29 of 2023 for the offences punishable under Sections 20(b)(ii)(C), 25 read with 8(c) NDPSA, on his executing personal bond for Rs.20,000/- (Rupees twenty thousand only) with two sureties for a like sum each, to the satisfaction of the Station House Officer, Pedabayulu Police Station, Visakhapatnam District.

5) The Petitioner/Accused No.1 shall co-operate with the Police in the investigation.

6) As a sequel, interlocutory applications, if any, shall stand closed.
