The Criminal appeal relates to the District Leh in Ladakh and, according to the administrative instructions, is to be heard by the Jammu wing.
The applicants want that it should be transferred to Srinagar wing for the purposes of hearing.
The appeal pending at Jammu wing can be heard through Video-conferencing if necessary, and it is not necessary that it should be transferred from one wing to another. Previously it was instituted in Srinagar but on account of the fact that the matters pertaining to Leh are to be dealt with by the Jammu wing, it was shifted to Jammu wing. In order to avoid shifting of cases from one wing to another, it is desirable that such cases, if necessary, be heard through video-conferencing and it is only, if in any case, some difficulty arises in hearing through video-conferencing and the parties insist for physical hearing that application for transfer from one wing to another be moved.
In view of aforesaid facts and circumstances, the transfer application is disposed of with liberty to the parties to address the Court through video-conferencing and, as such, there is no need for transferring of the appeal from Jammu wing to Srinagar.
In the event hearing may not be possible through video-conferencing or the parties insist for physical hearing, the applicants may, if advised, apply for transfer afresh.
It is also provided that if the applicants want to file any application in the appeal concerned, they are free to do it by e-mode from Srinagar itself.
The application is, accordingly, disposed of.
