Gafoor & Anr. vs The State Of Telangana & Ors.

Alleging interference by the respondent police by repeatedly calling the petitioners to the police station and compelling them to withdraw the complaint submitted by the petitioners before the Greater Hyderabad Municipal Corporation on 20.04.2026 at the behest of respondent No.4, this writ petition has been filed.

Heard Ms.J.Suchitha, learned counsel representing Sri Manoj Kumar Akula, learned counsel for the petitioners and Sri D.Pradeep, learned Assistant Government Pleader for Home, appearing for respondents No.1 to 3.

The learned Assistant Government Pleader for Home, however on instructions, submitted that an FIR has been registered against the petitioners herein vide FIR No.834 of 2026 dated 09.05.2026 wherein petitioner No.1 is accused No.1 and petitioner No.2 is accused No.3. He further submitted that as part of the investigation, the petitioners are being called to the police station.

On a query from the Bench as to the punishment prescribed for the offences alleged against the petitioners in the FIR, it is submitted that the punishment is less than seven years. In view thereof, the respondent police are directed to issue notice under Section 35(3) of the Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS) and follow the guidelines laid down by the Hon'ble Supreme Court in the case of Arnesh Kumar v. State of Bihar^{11.(2014) 8 SCC 273} before taking any action against the petitioner, strictly in accordance with law.

With the above directions, the Writ Petition is disposed of. There shall be no order as to costs. Miscellaneous applications, if any, pending shall stand closed.
