Judgment
We have gone through the judgment and order impugned by virtue of which directions have been issued to the official respondents to conclude the investigation in regard to F.I.R.No.46 of 2021 of Maddikera Police Station.
According to the judgment and order impugned, the investigation has to be completed preferably within a period of three months.
In the ordinary course, Courts do not fix time limits for completion of investigation. However, in the instant case, it can be seen that the words used by the learned single Judge are only to the extent that “the investigation be completed preferably within a period of three months’.
Learned counsel for the appellant would submit that such a direction with regard to considering the information furnished by the petitioner and conclusion of the investigation within a specific timeframe was resulting in a lot of harassment to the appellant who is being called on a daily basis and made to sit in the police station from morning till evening.
While the police authorities are within their right to conduct their investigation, yet the investigation ought not to result in undue harassment to any person including the appellant herein and that the appellant’s presence would be sought only if it is otherwise absolutely necessary.
The Writ Appeal is accordingly disposed of. No order as to costs. Miscellaneous applications pending, if any, shall stand closed.
